Dispute, mediation and conflict resolution
Finding financial clarity in conflict
Competing interests among partners or shareholders can lead to complex disputes requiring court intervention. These disputes can range from shareholder oppression, breachâofâcontract and jointâventure litigation to largeâscale, classâaction lawsuits.
Our experts can be appointed by the courts to manage assets at issue, provide in-depth analyses and reports, and review and assess the merits of the financial claims.
Acting as both receivers and inspectorsÂ
In our role as a courtâmandated receiver, we're charged with protecting stakeholdersâ interests by taking possession of â ââ and realizing on â ââ the assets in dispute. We can also be mandated to:Â
Carry on the business as normal, pending the disputeâs resolutionÂ
Conduct an auction between disputing shareholders, leading to one shareholder buying out the otherâs sharesÂ
Sell or liquidate the business, distributing the proceeds to the stakeholdersÂ
Meanwhile, as an inspector, we're tasked with gathering information â ââ the scope of which is determined by the court â ââ then reporting on the facts we discover. This entails:
Reviewing a companyâs premises or other property
Examining and analyzing financial recordsÂ
Gathering information from officers, employees and others knowledgeable about the companyâs affairsÂ
Our reporting covers the information requested by the court. It may also help disputing parties better understand their respective positions so they can determine whether to settle or pursue further litigation.Â
